Terms

Pilot terms

Draft for legal review. This agreement is not in force yet.Version 2026-10-21-draft-1. Marked items are open questions for the owner or the lawyer.

1. Who we are

These terms are an agreement between you and Boolean Bliss, LLC, which runs marketanything (“marketanything”, “we”, “us”). marketanything used to be called Engagemix.

2. The pilot

  • marketanything is open by invitation only. You join by texting the invite code you were given.
  • Free during the pilot. There is no card to enter, and nothing can be charged.
  • Either of us may stop the pilot at any time, for any reason. You stop it by texting STOP.
  • You must be at least 18, run a business in the United States, and have the authority to act for it.

3. What marketanything does

You text marketanything like a person. It:

  • learns your business from what you tell it and from your public listing and website;
  • finds businesses and people who could send you customers;
  • writes to them in your business's name, under the rules in section 5;
  • texts you the emails it prepares, the results, and any replies;
  • keeps a private dashboard of everything it is doing, reached by a link in your texts.

We cannot promise that any business will reply, refer customers, or buy anything.

4. Texts

  • Texts come from (628) 789-5383, over iMessage.
  • You accept these terms by texting back after our welcome text, which links these terms and our privacy policy.
  • We text you about your account and the work we do for you. How often varies with the work. Message and data rates may apply.
  • HELP gets a short help text. STOP (or UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPT OUT or STOPALL, sent as the whole message) stops our texts and the work in your name. We send one confirmation. Text START to come back.
  • “pause” stops new work until you say “resume”.

5. Emails we send in your name

You authorize us to write and send emails in your business's name to the businesses we find for you, under these rules.

Who it is from. Each email goes from a reply address we set up for your business. The sender name is your business's name, and the email is signed with the name you give us.

What it says. Only facts and offers you gave us. We do not invent prices, discounts or claims. You are responsible for the truth of what you tell us about your business and your offers.

The footer. Every email ends with your business's name, your mailing address, and this line: “If this isn't relevant, just reply and I won't write again.” Below it, a line names us as the company that sends it for you, with our postal address, and a last line gives a one-click unsubscribe link. We ask you for the address once, and no email goes out until you give it. A PO box works.

When an email goes.

  1. Your first day. Every email waits for your yes.
  2. Your yes. By text or by a tap on your dashboard. It goes right away on a weekday between 8 AM and 6 PM in your time zone, or else when that window next opens.
  3. After your first day, an email we showed you. If we showed you an email by name or in full and you did not answer, it goes 4 hours later, still only on a weekday between 8 AM and 6 PM in your time zone.

These stop an email from going on its own: “skip” or “not yet”; asking for a change (the changed email comes back to you first); “nothing goes out unless I say so” (no email goes without your yes until you lift it); “pause”; and STOP. An email we only counted (“3 more are ready”) never goes without your yes.

Follow-ups. If a business doesn't answer, we follow up at most twice in the same conversation, on business days, without a separate yes. Follow-ups stop when the business replies or asks us to stop, and whenever you pause or text STOP.

How many. At most 3 emails go out for your account in any 24 hours. More that you approve wait their turn.

Who we never email. We never email the same business twice from your account within 90 days, unless you ask for it by name. When a business replies, we text you what they said, and the conversation is yours from then on. When a business asks to stop, or its mail bounces or is marked as spam, no one using marketanything emails that address again.

Holding back. We may hold or not send any email, for example when a check fails. A held email is never sent by another route.

Contact forms. During the pilot we reach businesses by email only. We do not fill in website contact forms for you.

Gmail (optional). If Gmail is offered to you and you connect it, emails you approve one by one can go from your own Gmail address under the same rules. You can disconnect at any time. Our privacy policy says what we do with Google user data.

6. What we never do

  • Post anything publicly, on any site or social network.
  • Call, text or message businesses for you.
  • Buy anything, make payments, sign contracts, or create accounts on other sites for you.
  • Send from your own email account, unless you connect your Gmail.

7. What you authorize

You appoint us to act for your business only to write and send emails in your business's name, as in section 5. Nothing else. To the extent the law allows, we are not responsible for what a business does after it receives an email sent at your direction, and you agree to cover claims that arise from the facts or offers you gave us. (Pending our lawyer’s review.)

8. Your part

  • The facts you give us are true, and you have the right to use your business's name.
  • The mailing address you give us is real.
  • You tell us if someone has asked you not to contact them, so we never email them.
  • You don't use marketanything for anything illegal, to mislead or harass anyone, or to impersonate anyone. We may refuse work for a business we judge clearly illegal, and we may pause an account that breaks these terms.

9. Your data

Our privacy policy says what we collect and how long we keep it. You can text “send me a copy of my data” or “delete my data” at any time. We answer within 30 days.

10. When the pilot ends

  • Sending stops.
  • Your reply address stays open for at least 30 days after its last email, so late replies and opt-outs still reach us.
  • We delete your data when you ask, except the records we must keep: proof of your consent to texts, and do-not-contact lists.

11. Changes

If we change these terms in a way that matters, we text you before the change takes effect. Each version stays readable at its own dated address. We give at least 7 days' notice. (Pending our lawyer’s review.)

12. Disclaimers and limits of liability

marketanything is provided “as is” and “as available”, without warranties of any kind. To the extent the law allows, our total liability to you for anything related to marketanything is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect, incidental or consequential losses. You agree to cover claims that arise from content or facts you supply. (Pending our lawyer’s review.)

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts located in Delaware, and both of us consent to their jurisdiction. Before starting any claim, write to us and give us 30 days to try to resolve it. (Pending our lawyer’s review.)
